Max Wood wants to bring Georgia in line with the majority of States in our Country by creating the position of Solicitor General within the Georgia Department of Law.
Over thirty states in the United States have created a position similar in function to the United States Department of Justice model of a Solicitor General’s office where decisions on appellate issues are made.
Creating a Solicitor General’s office within the Georgia Department of Law will enable the Georgia Department of Law to develop expertise within its office focused solely on Constitutional issues that affect the rights of Georgia and other states under the 10th Amendment to the United States Constitution. Under federal Appellate procedural rules States such as Georgia have the right to file Amicus Curie briefs or “Friends of the Court” briefs in cases that have states rights or federalism issues at their center regardless of whether or not Georgia is a party or not. This approach allows Georgia to have input in a proactive way into legal issues that could affect Georgia in the future.
This approach to Appellate advocacy also improves the quality of Appellate advocacy by the Department of Law in the long term.
